I don’t think there is enough time to pull it off, sadly the rats are abandoning the cabinet too fast for the 25th to be invoked.

There is considerable debate on #lawtwitter about whether or not acting cabinet heads can satisfy the constitutional requirements to invoke the 25th Amendment. Most people who are specialists in the field say yes.

Also, someone pointed out to me that if you can install a new Supreme Court justice in a week, you can impeach in two.

There is enough doubt out there to stall/obfuscate.  If he delays in replacing them..well it’s less than a fortnight left.

I personally think he needs to go but there are some tricky thinkers out there..and with Pence apparently not on board I don’t see it happening.

I just read that there was at least one GOP Congressman, Derrick Evans, who actually participated in the riot? Mind boggles...

Any news of people being arrested? I know that the Bison Man is a rather well-known individual, for once?

Short Version- The then budding Nazi movement tried a similar coup with similar results in 1923. Historians are pretty sure that the Nazis were successful in taking over Germany in 1933 because the German government responded to the 1923 Nazis with just symbolic consequences to their actions to placate the masses and no major government changes. They thought they could placate the Fascists in 1923 but they ended up just Emboldening them.

This is my thought.  Although there have been several dozen arrests and some have been arraigned they might hold off on some of the more serious charges for a time.  One Capitol officer has died due to injuries received during the riot and this is being investigated but no one has been identified as yet.

The problem is that if he wants to pardon people he doesn't need to wait for prosecutors to file charges or for an investigation to be done. He can issue a broad, blanket pardon on the morning of January 20th and nothing could be done to prevent him.

"Acting pursuant to the grant of authority in Article II, Section 2, of the Constitution of the United States, I, Donald J. Trump, President of the United States, do hereby grant a full, complete and unconditional pardon to all persons who may have committed any offense against the United States when such offense 1) took place in the District of Columbia, Maryland, and/or Virginia and 2) occurred between January 5th, 2021 and January 7th, 2021."

Such a pardon is well within the president's powers and would preclude any federal charges against anyone so described.

Yeah, there don't need to be any charges pressed or even an active investigation to grant a pardon.

These are the terms of Nixon's pardon:

Note that it pardons him of any crime he "has committed or may have committed" between the two dates. So, even if new crimes were uncovered, Nixon would be pardoned of those crimes, too.

I am opposed to the death penalty.  There are many studies that prove capital punishment doesn't work, and one of the many problems with our prison system is a lack of focus on rehabilitation.  I value all human lives and believe that people can change, so the idea of anyone being 'blackbagged' and publically executed is, frankly, horrifying to me.

Got a couple of things from my feed.  First of all, there have been numerous arrests.  The most recent number I saw was 52, although this article from the Washington Post was released when the number was around 40.

Notable points: One person has been charged with possessing a military-style weapon and 11 Molotov Cocktails.  Another defendant needed a Russian interpreter.

Here's an awkward bit of speechifying:  The article includes a transcript of Trump's words to supporters at a rally that day on The Ellipse.  The end bit is particularly uncomfortable.

It sounds like most of the arrests have been for the slap-on-the-wrist offense of curfew violations though. A relatively small number of people are getting hit with serious crimes.

Most of the mob inside the Capitol have been named and identified that we know of, just through grassroots effort. It's more likely all but one or two have been identified, because all those phones being waved around uniquely identified their carriers when they automatically requested wifi access from the Capitol's servers.

To be honest if the FBI is doing their job then they're compiling a list of everyoen who was in the building and, quite frankly, on the steps. Whether or not they'll start making their investigation public before the 20th, well if that's how they played it, I wouldn't blame them.

I see that they arrested that Derrick Evans guy... Good. I honestly don't understand how can a Congressperson behave so stupidly.

A sidenote: is there no such thing as MP immunity in the States? Back here, the police wouldn't be able to arrest or charge an MP without the parliament agreeing to it.

Looking his details up, Derrick Evans is actually a member of the West Virginia House of Delegates, rather than the USA Congress, but he has behaved very stupidly. He has stood for the Democrats and Libertarians before becoming a Republican, although he is only in his mid thirties.

I don't know about the USA, but in the UK, MP Margaret Ferrier was charged by Police Scotland for culpable and reckless conduct when she broke covid regulations by travelling hundreds of miles on public transport after testing positive. She had already been suspended from the Scottish National Party and asked to resign her seat, but has refused to do so, but was charged without  Parliament having to agree to it.

There's even been some debate very recently about whether or not the POTUS can be charged with crimes.  It's currently an Office of Legal Counsel opinion that the POTUS can't be charged while in office.

Did a quick Google search, though, and I think this would say that we don't have anything approaching 'MP immunity'.
