This just in: are the Trump legal team getting ready to ditch their star Sidney Powell, the gung-ho lawyer who was going to turn the game around for them? Have they realized that her magnificent narrative of a worldwide DeepState /Commie conspiracy to wreck US elections and get rid of Trump didn't hold water, and that her loud, woolly rethoric risked making them look like fools in court all over again?

Honestly, it's not just that they have no evidence to back up their cases, it's the fact that these cases are just being so poorly put together. Rudy is out there openly antagonizing judges in his interviews, openly contradicting himself (for instance, in his first court appearance, he said that they are not arguing that there was voter fraud) and presenting patchwork, incomplete paperwork that one of the judges compared to Frankenstein's monster, and I doubt that he was saying that they are literary classics.

It's suddenly clear why self-respecting lawyers and legal firms are trying to put as much distance between themselves and these cases as possible. I honestly don't see any way that any of the lawyers involved find themselves work at any respectable firms after this is done. It's just so much incompetence.

With who, though? The party can't lose credibility with its own voters, or gain any with the Democratic voters. Anyone on between will be more likely to associate these shenanigans with Trump specifically rather than the party, so it costs the GOP leadership nothing to humor his lunacy compared to the consequences if Trump's cult thinks they turned on him.

Its sad, but they can't lose credit they dont have, and where they still have it they cant lose it.

They're appealing the denial of their motion to amend - which is kind of strange because I'm not at all sure they CAN really appeal that without also appealing the dismissal. I mean, if they get the 3rd to ONLY send it back for amendment, they're just going to lose most of the case on standing again - they'll get back the claim about the observers, but they'll lose that on standing, too.

I'm wondering if this isn't some sort of distraction from something else they're doing in the background. As mentioned, it is so obviously poorly constructed, and yet, so highly watched. I really can't help but feel like this is removing attention from something far worse.

Team Awesome Sauce has re-filed. I want to point out what's at issue in Trump's appeal to the 3rd Circuit isn't the judge's ruling against them on lack of standing and on the merits of their complaint. They are appealing the denial of permission to file a 2nd Amended Complaint. When they were denied the right to file a new complaint, the court said the reason why is that  that allowing amendment would result in "undue delay." When you are filing a "Motion for Expedited Review" with a court of appeal asking for a review of a decision that said that letting you do a thing would create undue delay, is it critical that you do everything humanly possible and more to show that you're not delaying anything.

They waited a full day to file their appeal, and now they're re-filing because they messed stuff up the first time. This is not a good look for them at the moment.

And again, they are only appealing the judge's refusal to let them amend their complaint and not on the substantive and procedural reasons for the dismissal of the lawsuit in the first place. There's a strong argument that by framing the appeal this way Trump is giving up any challenge to the things the trial court ruled, things that render the amended complaint dead on arrival.
