Do people who post porn images of themselves count as "semi-public" for the purposes of what images are allowed under the rules (#3, 2nd list)?

I believe it is fine to use porn actors, but avatar rules still apply (genitalia are not allowed, follow the public face guidelines on avatars).
Unless you have all the legal stuff, I don't think you are allowed to use any picture of yourself naked on E.

I concur with Saffron - he or she would probably count as a semi-public figure.

I think this sticky should answer the question on real-life pictures.

Quote from: Caeli1. DO NOT post pictures of anyone but yourself.  We request that faces of individuals other than yourself be blurred or painted over; alternatively, they can be cropped out.  Any material that you do not have the right to distribute should not be posted.

Two different replies from the same person.  Now I'm confused. ???

JackWhite

The first says that if you want to post a picture of yourself with friends or relatives on it, you have to blur them away because they can't see the photo and they aren't public or semi-public figures. The second says that a photo of yourself can be semi-public because we 'know' you.

Autumn Sativus

The first quote responds to pictures including yourself of your friends. Pictures you would be posting and saying "Hey, E, this is me!" about.

The sticky Oniya provided a link to is mostly pertinent to personal pictures that you wish to share of yourself. Often, you will take pictures with other people - say, friends and family. We do not want you to share images of people who are not able to give you permission to share a picture of them on Elliquiy, a site that they may or may not know the content. Sure, it might be possible to get permission and prove it, but it's easier if we ask you to just blur out their faces so that their privacy is protected. Obviously, your own face would be untouched, as that would be the reason you would be sharing.

On the subject of your avatar, the rule reads that you may not use images of, say, your best friend or your sister. You can use images of yourself; you may also use images of public figures (celebrities, musicians, and actors/actresses are popular choices) as well as semi-public figures, whom I would assume to mean people who aren't necessarily "well known" but who do legitimately have a public presence of some sort (for example, amateur models or actors/actresses come to mind) and put their own images on the internet.

Now, I wasn't sure if you were referring to yourself when you asked about amateur porn images for a character images (I apologize, I had read your question as asking about an avatar). If you are asking about yourself - yes, you can use pictures of yourself as an image because (1) the picture is of you, and (2) you would probably count as a semi-public figure, and (3) you have the distribution rights to your own image. If you are not asking about yourself, and the image is of someone else who is a porn actor/actress, the answer is still yes because of (2) s/he is a semi-public figure.

Nope, I'm talking about player characters.

I'm asking about someone who isn't a formal porn star who posted nudie pics of him/herself on the web.

I'd ask the staff if you want a confirmation either way, but if someone puts those pictures up him/herself, I'd say the pictures would be fair game for usage. S/he is distributing them, after all. It's a pretty gray area, though, so you might want to wait for a staff confirmation if you want to be sure.

There aren't - technically - any formal rules about what you can and can't use for character images. Generally, I'd say that if you know the artist/photographer does not want the image to be replicated, cropped, or used, then you shouldn't use it; otherwise, the interwebz is pretty much fair game.

It depends on the context, really. Are you talking about using this person for your avatar? As a character portrait?

If it's a character portrait, I don't see a problem with it. If it's nude, it'll have to be in a private area of the site.

If it's an avatar, on the other hand, I would say that stock photos from modeling sites & whatnot are fair game. But not if it's an image of someone who was just careless about where they left their nude pics lying around.

I had a brief stint in photo developing, and after having people bring in plenty of nude photos to be developed in-store in an hour, I can attest that people do indeed not care about where they leave their nude pictures lying around...ugh, having to look them in the eye when they came to get them...

And especially since that out of all the times it happened (far more than I would have initially wagered, given the chance), maybe only one of them was actually tastefully nude, like in a glamor sense. The others were just blatant nudity and/or what could have been home porno attempts.

This exactly... That's part of my job, and the number of people having their friends snap them having sex on a disposable camera is surprisingly large. Some have been tasteful, but most were not...
