Action Needed! [Interest Check]

So I have been needing a true action game for some time.  Myself, and my husband, SinXAzgard, are both interested in starting.  We are looking to have three to five players total. 

First Idea- Dungeons and Dragons 3.5
The matter of a DM is debatable... I can DM if that's the need, I have many PDFs of games that we can run through.  We can run through with a plot in mind but just have free run. I did find a nifty Dice Roller on my browsing through the mass of the Interwebs that we might use if it comes down to an old fashion D&D game.

Second Idea- Spartacus: Blood and Sand Inspired
Ever watched this? Besides the mass amount of nudity and sex, the blood and gore value put this high on my list of things to do.

Are you looking for a general interest in an action game?

I'd be up for a D&D game high on action if that's the end plan. I've never seen Spartacus: Blood and sand and would probably duck out if you do something freeform inspired by it though.

End game is action.  Less sex mostly. ^ ^  I only mention spartacus because we both like the gladiator aspect, but I understand completely!
